The observation that led to the conclusion that nucleus is positively charged is that while, doing the scattering experiment on the golden foil, a few of the alpha particles which are positively charged returned back along the same path while some of them refracted with their paths and some of them passed through the foil easily.

This led Rutherford to conclude that their is a positively charged substance in the center of the atom(nucleus) that had repelled with the alpha particle(+ + = Repulsion, same as the magnet where like poles repel each other.
