the student failed by 3 marks
thus, marks required to pass = 65 + 3 = 68

Let the maximum marks be x
thus 40% of x = 68

--> 40/100 * x = 68
--> x = 68 * 100/40
--> x = 17 * 10
--> x = 170 marks

Thus the maximum marks are 170
