If there is a conflict between the state government and the union government on the subject of the concurrent list then the law made by the union government will prevail.
What is a concurrent list?
- Three lists are mentioned in the seventh schedule of the Indian constitution which includes subjects on which central and state governments can make laws.
- These lists are- state list, union list and concurrent list.
- Concurrent list is one of the three federal lists and it includes subjects on which both central and state governments can make laws. For example- education. But, if there is a conflict between state and central laws on the subjects included in the concurrent list then the law made by the central government will exist.
Note:
- State list- It includes subjects on which state government can make laws e.g. police.
- Union list- It includes subjects on which union government can make laws e.g. defence.
