A workplace is defined as ‘a place at which the employee's attendance is necessary in the performance of the duties of the employment’ (ITEPA 2003, s. 339(1)). The focus is therefore on the purpose of the attendance rather than on the purpose of the journey, a subtle distinction that can have practical applications.

The word ‘the’ before ‘employment’ is significant, meaning ‘the employment in question’ and not just any employment. It has the effect, for example, that an employee travelling between two separate employments will not normally obtain relief for the cost of that travel.

An exception is made for travel between two employments where the different employers are companies and members of the same group, such that one company is a 51 per cent subsidiary of the other or both are 51 per cent subsidiaries of a third company.
