a) Dushyanth, a Charted Accountant, employed another Charted Accountant Abhinav as assistant for
period of 3 years on salary of Rs. 40,000/- p.m. There was an agreement between Dushyanth and
Abhinav which provided that after termination of his employment Abhinav shall not practice as a
Charted Accountant within radius of 5 km of Dushyanth's dispensary for period of 3 years and if
Abhinav did so, Abhinav should pay Rs. 1,00,000 as damages. But during his employment itself
Abhinav started his practice as De next to Dushyanth's dispensary. Dushyanth thereupon sued
Abhinav for recovery of Rs.1,00,000. Will he succeed?
