A judge is going to decide whether to send the murderer to prison or not. The jidge knows that the convict will not commit violet crimes anymore, and wants to be a lenient since he is already old and terminally ill. He also knows that this will make the convict very happy, not to mention his family and friends. Imagine that the victim's family forgiven the convict and all not feel pain if the judge decided to free to convict. If you are a utilitarian thinker, what wobe your decision as a judge?.

The decision of the judge should be free from all the "what ifs" or "what his family will feel about him" this is not a sign of independent judiciary. You should give a decision straight to what he's done and no one knows whether he is gonna do a crime again.

Decisions about crimes are not based on emotions it only depends on records and evidences. If judge will give order to free the convict this may increase more criminal activities any criminal will think that he would commit the crime and ask to live a lenient life.
