in India the emergency must be placed before the Parliament and gets its approval and it must be given to the president for his approval if it is not approved then emergency cannot be declared .in India what emergency was declared by Indira Gandhi when Supreme Court appointed from contesting elections of 1971 she had called for a parliament in which half of the total members were not present and she easily got the asset of the Parliament .then she gave her report to the president that emergency is approved by the Parliament and there is a need of National Emergency because of the tensions with Pakistan any chances for war and communal issues and a chance for civil war .the president found these charges correct and gave approval for it and that emergency prevailed in this country for 6 years and national election called by the Indira Gandhi 1977 in which she lost the elections in her home turf and Congress lost badly and first non Congress government came to power in which is called as the Janata sarkar under the banner save democracy.emergency is called in the outermost situation that the government cannot function because of riots , communal violence or the country is leading to a civil war or war with other countries.
