Answer: No , it is choice  of the company  or the person .

Explanation: If the company or the person want to distribute then he can can distribute it . They can keep it as private software that is  user keeps it and uses it, and does not release it to the public either as source code or as binaries . If he release it then it is public software  . Public software is 'software developed or procured, for the public good, which is publicly owned'.
