Difference between a legal offence and a moral offence:

  • It can be difficult to distinguish between moral and legal responsibility; law enforcement officials must be mindful that what may be morally acceptable may not be legal. While it is true that when resolving moral quandaries, officials should take into account any applicable rules or regulations, they also need to take into account the moral culpability of all of their activities, regardless of whether there are no legal repercussions. An officer who overlooks a homeless person extending her hand for help may serve as an example in a legal setting. Even though there may not have been a policy or legal violation, the officer's actions may be seen as morally wrong if the homeless person later suffers injury when the officer's intervention may have prevented it.
  • The cop who failed to aid the person may be seen as ethically responsible for the injury. Another instance might be a police officer who neglects to look into a crime because of a large workload. Depending on the logic behind the officer's choice, it may be argued that the investigator's decision not to investigate made him or her morally liable should the omission of the inquiry result in a preventable assault. It may be concluded that the officer was not morally liable if the officer thought the situation was not as serious as some others. However, if the police made their judgement based on the victim's race, they would be morally responsible for the assault that took place.
