Bhagat Singh, Rajguru and Chandrashekhar Azad assassinated ASP John Saunders, whom they mistakenly believed to be Scott, the police officer responsible for brutally assaulting Lala Lajpat Rai-that ultimately led to his death. Since nobody could identify Bhagat Singh at the scene, he was not mentioned in the FIR as well.

Three years later, Bhagat Singh was arrested for throwing bombs into the Central Assembly. Since the bombs were not meant to kill, it was unlikely that he would charged with a capital offence. But while in custody, the police arrested many other revolutionaries-some of whom broke down in the face of torture and disclosed Bhagat Singh's role in the Saunders assassination case. A Special Tribunal was therefore constituted to try the case-an attempt by the British to circumvent the usually slow process of law. The Tribunal found Bhagat Singh, Rajguru and Sukhdev guilty under Section 300, 302, 121, 34 etc of the IPC and sentenced them to death by hanging-the only punishment for murder those days. An appeal to the Privy Council was turned down by Lord Dunedin.
