At noon, water in the deeper areas of a pond is cooler than that at the top because the surface water gets the heat of the mid-day sun.
The surface water hit it off with from below 4 degree C to above 4 degree C, at no point getting denser than the underlying water at 4C.
However, the process of convection does not mix warmer water on top with the cold underlying water, and it can maintain its cold temperature.
