No, I don't feel sorry for Ben because of two main reasons. Firstly, Ben was a bully and was out to tease Tom. He tried his best to make Tom feel miserable about being stuck with the task of painting the fence. So, he was not 'innocent' at all.
Additionally, though the author says that Ben was a 'victim', Ben himself wanted to paint the fence and enjoyed it as well. Here again, there is no scope for feeling sorry for him.
I think boys like Ben should be treated the same way that Tom treated him. Tom's quick thinking made Ben want to work. Also, he did not think of it as work. So, Tom handled Ben in a very smart, psychological way.
