According to the Act led down by government of India, Without prejudice to the provisions of the Act, a Pradhan and Up-Pradhan may be removed from office by the Government for misconduct in the performance of their duties or incompetence or incapacity to perform their duties or persistently for failure to perform their duties or for being guilty of any disgraceful conduct:
Provided that, unless he has been given a fair opportunity to defend himself, no such Pradhan or Up-Pradhan is removed from office.
The dismissal of Pradhan or Up-Pradhan under sub-section (2) during the remaining term of office shall not qualify for re-election as Pradhan or Up-Pradhan.
