it depends on the nature of the material of the ball .
if it's made with some heavy metal, then the person may die.
but if it's a rubber ball or something then the person might get hurt but will not die

You see, Empire State Building is too high (about 350 meters) and a ball dropped from such a height should be able to create a huge impact on someone's head. But I really don't know if it could kill him. Practically thinking, if it's a baseball then the impact is good enough to carry the person's soul staright to hell but if it's some regular soft kind of ball then it might cause a huge bump but not kill someone.
