Yes, it should be.

Capital punishment is not a deterrent. If the person found guilty is executed, this will not prevent another criminal from doing the same crime.

Judges are humans and humans are likely to make mistake. After the execution if the guilty is found innocent, there is no way to give back his loss.

Most of the countries already abolished capital punishment as this will not serve the purpose of criminal punishment.

There should not be a point of revenge in criminal justice system. The aim of the punishment is to make the guilty a better citizen by realising his deeds and prevent the same from happening again.

Instead of judicial execution the criminal should be sentenced to life imprisonment. I think in the case of life imprisonment, respective state Governments in India can free the guilty if he had served particular years in jail. This should be abolished and the life imprisonment should be till the death or at least 50 or 60 years.

Trend in India is towards the ban. It has not reached zero but tending towards it.

Awarding capital punishment has been circumvented to rarest of rare case of cruelty and cold-bloodlessness by Supreme court.

Even among awarded actual happening of it is very less.Most of the decisions of trail court is converted into life sentence by Higher courts.

Executive head of state also pardons generously.

It has been kept in the book but used very sparingly depending on mood/percussion of general public. If it is going to generate more heat(violence ) by letting him, Government usually go for the final verdict of capital sentence.

Base line is-

There are some offences which are unforgivable especially terror/violent extortion cases.
