The Ghaziabad District Consumer Forum has ordered the Easy Day Bharti Retail Ltd. to pay Rs.55,000/- as compensation to the Complainant Mr. Shashank Mishra in case No.433/15.
The Case:
Shashank Mishra vs. Bharti Retail Ltd., Ghaziabad, Bharti Enterprises Ltd., New Delhi
Mr. Shashank Mishra had bought one Listerine brand mouthwash from Easy Day Retail Store at Govindpuram by paying Rs.115/- through his credit card on 31-01-2015. Later he found that the MRP of the product was Rs.110/- and he has been charged Rs.5/- more. He brought this to the notice of store Shift Manager but it did not produce any result. Mr. Mishra again bought the same product from the same store after three days and this time too he was charged Rs.115/-. Hence, Mr. Mishra filed this complaint with the District Consumer Forum.
During the hearing, the respondent produced a mouthwash bottle with MRP Rs.115/- but this was different from what Mr. Mishra had bought. Since the Respondent could not give any justifiable explanation, it was established that the store had collected more than the price printed on the bottle. Though Mr. Mishra brought this to the attention of the Consumer Forum, but there could be many customers from whom the store has collected more money than the printed price.
Order:
The Respondent was ordered to pay Rs.50,000/- towards compensation for physical and mental harassment and Rs.5,000/- as legal costs. Order Dt.09-06-2017
