In Presidential form of government checks and balances exist when the three branches of the government, that is the legislative, the executive, and the judiciary are kept in check by one another through the system provided in the Constitution.

Explanation:

  • In Presidential form of government, the President is the head of the nation, and also the head of the executive body of the state. But this does not mean that he/ she can give any orders. His/ Her orders would be verified by the the legislative.
  • The best example of this form of government is the United States of America, where President is the head of the executive, but his orders are kept in check by the Congress, which is a legislative body consisting of House of Representatives and the Senate.
  • In the same way, the legislative is kept in check by the executive when the President uses the power to veto the Bills passed by the Congress. Also, the judiciary keeps checks on the legislative by making sure that they do not make any law that is unconstitutional, or it can declare that law as null and void.
  • The judiciary is kept in check by both the executive and the legislative through the appointment process of judges of Supreme Court and Federal Courts, because the President appoints these judges after they are confirmed by the Senate.
  • This system of checks and balances is necessary, so that no one branch of government has more powers over the other.
