Fair discrimination is the type of discrimination at workplace that is permitted by law.

It can be allowed in four cases:

1. Discrimination which is based on an affirmative action.

2.Discrimination which is based on the aspect of productivity.

3. Compulsory discrimination( as permitted by law)

4. Discrimination which is based on the recruitment requirements.

Employers often employ young females because women are more patient, can endure more and repeats one task several times in case of an error, capable of building good relationships, better leaders as compared to men and also consistent with their decision.

We can describe fair discrimination as legal discrimination. We know that discrimination essentially refers to giving preferential treatment to group of people based on caste, gender, sex and other factors.

However in many institutions it has been seen that there exists a situation of fair discrimination which means that in order to overcome these biased discrimination a section of people have to be recruited. There is no other replacement for that particular spot
