The minimum criterion for that party to be a national party is that it should have MLAs or MPs in at least four states. Such a party gets the status of a national party. The national party contests elections to the Parliament and the Legislative Assembly in each state.

State Party: A state party is a party that is confined to only one or two states. She does her politics on the basis of the state subjects of the respective state. The mass base of that party is not outside the respective state and that party is also interested in the politics of the state. It focuses only on the elections to the Legislative Assembly.
