The government keep checks on child abuse by enforcing constitutional laws, and taking strict actions which are discussed below.

Article 39 of Part IV of the Indian Constitution instruct the State so that

  • the children are not abused,
  • Not compelled by economic necessity to file advocacy for his age or strength

Several constitutional rights have been given to the citizens below the age of 18:

  • Right to elementary and compulsory education from age 6 - 14.
  • Article 24 provides the right to be safe from any dangerous activity.
  • Article 39 provided the right to be protected from misconduct by economic necessity.
  • Article 23 provided the right to protection against forced labor and slavery.

These rights fulfill the needs of children by addressing matters like  Childcare through protection, development, treatment and social reinforcement.

The government and the law guarantees justice to the children who were abused in any way. For example:

  • POCSO: it is the Protection Of Children from Sexual Offenses Act, 2012. The act punishes the abuser by imprisonment plus a fine.
  • Section 376 of the Indian Penal Code (IPC) punishes the rapist of a child.
