The Court is the judicial branch of government. As an independent branch of government, they are intended to ensure that the accused is accorded all relevant rights and that the procedures used in hearing the case are followed. In a jury trial, they are the referees.

The jury are finders of fact and assignors of guilt. The jury is intended to be a wide range of fellow citizens who represent the people and their values. When a defendant waives their right to a jury trial, they defer that decision to the judge. In furtherance of their roles as referees, a judge can set aside a guilty verdict by the jury if it is out-right wrong.

The policy, and by extension the prosecutor, are members of the executive branch. As an independent branch, they are responsible for a fair execution of the law. They do not work for the judicial branch (the court), though they are called officers of the court.
