Explanation:

The President is indirectly elected by electoral college comprising the parliament of india ( both houses) and legislative assemblies of indian states and territories. Although the article 53 constitution of india president can excercise his power directly or by subordinate authority, with few exceptions ,all of the executive power vested in a practise , excercised by prime minister ( a subordinate authority ) with the help of council ministers of india.

Discretionary powers of The President of Republic of India :-

  1. The President can appoint the Prime Minister of India in a situation is no individual party wins the clear support of the majority of the Lok Sabha members, or the parliament is hung. This power is given to The President because he/she cannot appoint a new Prime Minister on the advice of the outgoing Prime Minister who may have lost the election or the support of the Lok Sabha.
  2. The President can also appoint a new Prime Minister in case of sudden demise of an incumbent Prime Minister when the ruling legislative party is unable to meet immediately to elect a leader. (e.g., assassination of Mrs. Indira Gandhi)
  3. When the motion of no-confidence is passed in the Lok Sabha and the ruling party lost its majority support in the house, then The President has got powers to either dissolve the House or ask another political party to prove its majority in the House.
  4. The President can dismiss Ministers in case the Council of Ministers loses the confidence of the House but refuses to resign.
