The structure of the Council of Ministers is like wheels within a wheel wherein the Cabinet constitutes the inner most ring.The Cabinet is an extra-constitutional body. It is a part of the Council of Ministers and consist of 15-20 top level ministers who undertake the function of policy-making. In other words, all Cabinet Minister are Council of Ministers but all Council of Ministers are not Cabinet Ministers. The following points illustrate the difference between the two:-
1:) First and foremost, Council of Ministers is a wider body of which the Cabinet is a small but most powerful part.
2:) All ministers constitute the Council of Ministers whereas the Cabinet consists of the top 15-20 ministers only.
3:) Policy-making is performed by the Cabinet and not by the Council of Ministers
4:) Only the Cabinet ministers take part in the meetings of the cabinet. Other ministers attend only when specially asked by the Prime Minister. A full meeting of the council of ministers is rarely held.
And for the appointment part:- After the appointment of the Prime Minister, the President appoints all other ministers upon the advice of the Prime Minister and distributes portfolios among them. The Prime Minister is the sole judge to decide who shall be the minister, which portfolio will a particular minister get, will he be a cabinet,state or deputy minister.
