what is a fundamental right?

ans: it is the section referred to as the conscience of the Indian constitution. colonial rule had created a suspicion of the state in the minds of the nationalists and they wanted to ensure that a set of written rights would guard against the misuse of state power in India. fundamental rights therefore, protect citizens against the arbitrary and absolute exercise of the power by State.


FUNDAMENTAL RIGHTS IN THE INDIAN CONSTITUTION ARE:-

1. right to equality:- all persons are equal before the law. it means that all are equal and protected equally by the laws of the country. it also states that no citizen can be discriminated on the basis of their religion, caste or sex. every person have equal right to go in any place, hotels, shops etc.

2. right to freedom:- this is the right to move freely and reside in any part of the country. right to practice any profession.

3. right against exploitation:- the constitutional prohibits human, forced labour and children working under 14yrs of age.

4. right to freedom of religion:- religious freedom is provided to all citizens in our country. every person has the right to practice any religion of their choice.

5. cultural and educational right:- it states that all minorities, religious can set up their own educational institutes and can develop their own culture.

6. right to constitional remedies:- this allow citizens to move the court if they believe that any of their fundamental rights have been violated by the state.

1. Right to equality: the government shall not discriminate against any citizen on the grounds of religion,caste, ethnicity,sex or place of birth.
2. Right to freedom: Freedom of speech and expression, freedom to form association and unions, freedom to move freely throughout the country.
3. Cultural and educational rights:It is language, culture and religion of minorities that needs special protection.
4. Right to constitutional remedies: it is the fundamental rights we can directly approach to supreme court or high court of a state.
5. Right to freedom of religion: every person has a right to choose, practice and propagate any religion he or she believes in.
6. Right against exploitation: forced labour or begar is banned, child labour is prohibited.
