Constitutional Right are God given laws of nature, as was so eloquently defined in the Declaration of Independence. These rights can only be taken away by the ratification of a constitutional amendment, a feat that has only been accomplished 17 times since the ratification of the first 10 amendments (The Bill of Rights) in 1791) in the last 225+ years. The government created under the auspices of the constitution exists ONLY to protect the rights of the people — the rights of the people are limitless, unless the people, through the constitution and amendment process, have delegated the powers to the federal government.

State government powers are also limitless, unless the states have delegated certain powers to the federal government through the constitution and the amendment process.

These two rights are defined in the 9th and 10th amendments of the Bill of Rights.

It spells out Americans' rights in relation to their government. It guarantees civil rights and liberties to the individual—like freedom of speech, press, and religion. It sets rules for due process of law and reserves all powers not delegated to the Federal Government to the people or the States.
