Legal process (sometimes simply process) is any formal notice or writ by a court obtaining jurisdiction over a person or property. ... Process normally takes effect by serving in on a person, arresting a person, posting it on real property, or seizing personal property.
Due process of law involves two types of processes: (a) procedural due process – Is the process fair? and (b) substantive due process - Does the government have the right to bring the action in the first place? In performing the LHO duties and responsibilities, you must be concerned with whether the process is fair.
Public law concerns government and society, including constitutional law, administrative law, and criminal law. Private law deals with legal disputes between individuals and/or organisations in areas such as contracts, property, torts/delicts and commercial law.
