1) Principle of cause proximo:- Proximate cause means the active, efficient cause that sets in motion a chain of events which brings about a result, without the intervention of any force started and working actively from a new and independent source.
The proximate cause is not necessarily the first cause, nor the last cause; it is the dominant, efficient or operative cause.
While determining the liability of the insurer, the proximate (nearest) cause alone and not the remote cause is to be considered. The insurer is not liable for remote cause even if it is one of the insured perils. Therefore if the immediate cause is an insured risk for the occurrence of which the insured is to be paid, the insurer is liable to make the payment of loss under the policy, otherwise not.
2) Principle of mitigation:- Mitigation means keeping your losses after an accident or injury to a minimum. Reasonableness is the guiding principle. When you claim compensation after an accident you have a duty to mitigate, or keep your losses to a reasonable minimum. Your response to the problems created by the accident must be reasonable.
