The Fundamental Rights as incorporated in the Indian Constitution framed in 1950 can be classified as follows:

(i) Right to equality,

(iii) Right against exploitation,

(iv) Right to freedom of religion,

(v) Cultural and Educational Rights,

(vi) Right to constitutional remedies.

i will explain these Rights in the forgoing text:

A. Right to Equality (Articles 14, 15, 16, 17 and 18):

The Constitution of India contains five different provisions concerning the right to equality.

They are as under:

Article 14 specifies that the state shall not deny to any person equality before the law or the equal protection of the laws within the territory of India.

i will explain below this Article as Equality before Law.

(a) Equality before Law:

The Article guarantees equality before law to all persons and not to citizens alone. No law can discriminate unfairly between one group of citizens and the other or between citizens and foreigners in relation to the same matter. In the words of J. Dixit, “Equality before law does not mean an absolute equality of men but postulates that there shall not be any special privilege by reason of birth or creed or the like in favour of an individual. Equal protection must mean that there will not be arbitrary discrimination made by the laws themselves in their administration.”
