Explain the term “Delivery and its form” under the Sale of Goods Act, 1930.
As a general rule, goods can be transferred by doing anything, which has the effect of placing the goods in the hands of the buyer, or anyone authorized to hold them on his behalf.
Types of delivery are as follows:
Actual delivery : When the goods are delivered to the buyer. His car is sold to B and the car is handed over to B. A handing over of the car to B is a de facto transfer.
Express delivery : Also known as delivery by acceptance. When the delivery is made without any change in the possession or effective possession of the thing or goods.
The goods were kept in O's warehouse. Later, he sold the same goods to B and told O that the goods were now in his possession.
