Constitution of India enlists fundamental rights in part 3, which are the rights of citizens against the state. Neither executive nor legislature can deprive of your fundamental rights without appropriate constitutional amendments. Citizen's right to seek remedy for deprivation of fundamental rights is itself a fundamental right under article 32.
