fundamental rights aren't applicable in times of emergency. they are curtailed. citizens cannot enjoy their fundamental rights until emergency is called off. the country assumes a unitary form and administration of states comes in the hands of the union government. in times of emergency, the union government can arrest anyone. it is on grounds of preventive detention.

hence only for sake of protection of citizens these rights get curtailed and are restored when emergency is called off.
