Ganesh sold some goods to Harish for a certain price by issuing an invoice dated March 15, 2020.
Harish promised to pay the price later. Ganesh immediately ordered his men to pack the goods and
set them aside separately in their godown. After a few days, the goods were inspected by the agent
sent by Harish and found them to be in order. On March 25, 2020 Harish paid the price to Ganesh in
cash. Ganesh informed Harish that the goods should be taken away from his godown to enable him to
store other goods purchased by him. Even after a day, Harish did not take delivery of the goods and
therefore Ganesh ordered his men to keep the goods outside of the godown in an open space. Due to
an unexpected sudden downpour, the goods were drenched.
Referring to the provisions of the Sale of Goods Act, 1930 you are required to analyse and decide as
to who will be held responsible for the damage to goods kept in the open space.
