First generation rights deals with the civil and political rights. These rights presupposes the equality principle among all and are safeguards against the excesses of the state, thereby seeking negative action on part of the state.
Second generation rights are the larger social, economic and cultural rights, which establishes the fact that material inequality among individuals is inherent, thereby demands positive action on part of the state. This generation of rights provides scope for affirmative actions on part of the state.
