Jammu and Kashmir have separate constitution because Article 370 of the Indian constitution grants special autonomous status to Jammu and Kashmir. When India and Pakistan gained their independence on 15 and 14 August 1947, respectively; J&K chose to remain independent. There were, at that time, standstill agreements of J&K with Pakistan and India. However, on 6 October 1947, Muslim tribes, supported by the government of Pakistan; attacked Jammu and Kashmir. To save his state Maharaja Hari Singh (the then ruler of J&K) chose to accede Jammu & Kashmir to India, so that India could help in defending her. It was in the pursuance of those commitments that Article 370 was incorporated in the Constitution.
According to the Article 370 of the Constitution, Jammu and Kashmir enjoys a special status in the Indian governing system. It was included in the constitution to provide special privileges to the state but some scholars are of the view that this article has hindered the growth of the state. The reason being the state does not have much resources to go about the process of development. Also, most of the schemes of the government can either be not implemented in the state or implemented through special order of the Governor. This puts the state behind in the overall process of development.
