Ubuntu means "love," "reality," "peace," "feeling happy" etc. Ubuntu is a human being's soul, the spiritual spark of the goodness of every being. African cultures have been guided by the universal ideals of Ubuntu since the dawn of time. Ubuntu was and continues to be the guiding principle how one connects with other human beings, nature or the Creator. In Africa and around the world, Ubuntu is extremely important-because the world needs a shared human principles guiding principle. Ubuntu is at the heart of the ideals of society and without Ubuntu society has greed, egotism, immorality, pride etc.

Explanation:

  • According to Ubuntu, people should follow a simple statement of 'being self through others'.'buntu ngumuntu ngabantu' is written in the Zulu language of Africa that means 'I am because of who we all are'.In the Criminal Justice system, every victim should be treated with values of humanities such as respect', 'care', 'compassion', 'love', 'solidarity', 'sharing', 'reconciliation', and 'reciprocity'.
  • When criminal or victim is treated with such values of Ubuntu, it has been said that they had ensured justice to humanity of the world
  • Some of the compelling points in favour of Ubuntu had to do with Ubuntu's broader definition of fairness. Justice is, by nature, a fairness on the part of the victim and a pain to the perpetrator. At the other hand, Ubuntu is the philosophy of harmony between all that is humanly good & reasonable to a overwhelming "majority of the community" & people.
  • Throughout the sense , Ubuntu has become a vital part of the principles & values  of the Constitution that guide the "interpretations" of the "Bill of Rights" & other legal areas. In specific, the case law comprising eviction, customary law,  criminal law, &  defamation has become obvious on the subject of restorative justice
  • The criminal justice system includes three main structures that handle prosecutions from the outset through to conviction and sentencing At each point of the trials, procedural protections are required to make sure that justice respects the interests of the arrested and guilty and not the rule of law, which is simply the foundations of Ubuntu.
  • The values of Ubuntu provide a sense of interrelation that highlights the need for equality, unity and justice in society. Under Ubuntu values, lawyers must understand the ability they have to make, to defend the interests of poor citizens & influnence public policy on a daily basis.
  • It is the 1st phase of criminal justice for the police, Ubuntu is important when dealing with a suspect. The " law enforcement  officers" must understand that they are dealing with someone who are like them in "their nature" and they must hence handle any suspect so as to protect their "dignity", which is one of the core concepts of "Ubuntu"
  • And it is the second phase for   the "judiciary functionary" for all participants in the trial system. Ubuntu acknowledges the "common links", the "sense of inter-connection"  between "humanity" & encourages them to use their legal know-how on a day-to-day basis to "promote" social good & pursue "humanitarian goals". Ubuntu., hence draws on a "relational view".
  • The punishment must represent the morale of the community that is ready by reconciliation  to rehabilitate with the community. It highlights Ubuntu's sensitivity and humility and our courts must uphold the philosophy by returning the chance of the offender being reconciled with the community.
