The constituent assembly was constituted in 1946.

The total number of seats was 389.

i. e. 296 Seats for British India and 93 Seats for Princely States.

Out of the 296 seats for British India 292 seats were filled by people from Eleven Governors' Provinces and 4 seats by people from Four Chief Commissioner Provinces.

In each Province and Princely state roughly one seat was allowed for every one million population.

In British Provinces seats were divided among three principle communities namely the Muslims, Sikhs and General.

The representative of each community was elected by the members of that community by the method of voting by proportional representation by means of single transferable vote.

The representative of princely states were nominated by the head of the Princely states.

Hence, the constituent assembly was partly elected and partly nominated.

The elections to constituent assembly was held in July to August, 1946.

The Indian National Congress won 208 seats and Muslim league won 74 seats. The seats of princely states remained vacant as they decided to stay out of the constituent assembly.

Although the constituent assembly was not directly elected by the people of India on the basis of Universal Adult Franchise,it consisted of members from all sections of the society say, Hindus, Muslims, Sikhs, Indian Christians, Parsis, SCs, STs, Anglo - Indians which include women of all these sections.
