Federal structure of India and the Indian Constitution

Explanation:

Both federal and unitary features are enshrined in the Indian constitution. Federal in all normal circumstances and unitary in emergency conditions.

  • Sechedule 7 of indian Constitution provides India with 3 kinds lists. These lists very specifically describe the power separation among union and state.

  • Article 368 provides power to amend the constitution whenever required. When parliament at centre legislate on matters relating to states. The state must first pass the resolution in their respective legislative assembly then it becomes applicable as law.

  • Eg. 1. 101st Constitutional amendment was done for the purpose of GST implementation. It has shown the quality example of the federal structure of India and how it goes into more strength with it's implementation.

  • 2. 102nd amendment was recently done for the purpose of providing reservation to economically weaker section. States showed the excellent example of federal structure implemention by passing resolution of enactment in their legislative assemblies.
