Since the independence of India, The constitution formed had been protecting the rights of marginalized section of society in India.
- The Constitution makers knew that in a diverse country like India, Reservation were essential for the development of underprivileged sections of society, so they came up with Article 334, 16, 335 and many sch articles that gave reservation to these sections for 10 years only. But after it, decade after decade, the date of reservation tenure was extended in amendment acts.
- The earlier one was the solution for the race, caste or religion based. But soon the government realized the need to help women also develop. Thus under the women's reservation bill(108 Th amendment), 2008 gave 33% reservation for women in the local level 3 rd tier government. Reservation for women at centre and state is yet not passed.
- In 2019, the Union Government of India passed the 124th amendment bill that gave 10% additional quota for the economically weaker sections amongst the erstwhile unreserved category students.The constitutional amendment has laid down that they will be restricted to people with household income less than 8 Lakh per annum, or those who own agricultural land below five acres.
As per the current situation, the lower caste people do not practically need reservation. It is not essential for a dalit who resides in big bungalow with a BMW to avail benefits of reservation. rather the Brahman who is a beggar now needs reservation.
Thus reservations have improved the conditions of marginalized sections.
