In civil cases, the traditional number is still 12, but the use of smaller juries is common in federal courts and some state courts. Because the minimum number of jurors is generally considered to be six, many judges will seat 7–8 jurors (they like to have couple of extras in case somebody gets sick), and then all of the jurors participate in deliberations.
