When the constitution was formulated there was a provision which stated that nine states needed to vote for the constitution, for it to be approved.

This provision was the Article VII, which clearly stated that nine states had to ratify the constitution.

The congress had some role to play here as well. Hence on the 28th of September congress gave orders for this.
