A BRIEF TOUR REPORT OF SECRETARY (JUSTICE) IN THE EXPERT GROUP MEETING OF
SHANGHAI COOPERATION ORGANIZATION HELD AT TASHKENT ON AUGUST 10-11, 2017.
The two day meeting of the Expert Group on preparation for the Fifth Meeting of the
Ministers of Justice of the Member States of the Shanghai Cooperation Organisation (SCO)
was held at Tashkent on August 10-11, 2017. The two member delegation from India was
led by Mrs Snehlata Shrivastava, Secretary, Department of Justice. The other member was
Mr Suresh Chandra, Secretary, Department of Legal Affairs. A list of participants from the
other member countries namely China, Russia, Pakistan, Kazakhstan, Kyrgyzstan, Tajikistan,
Uzbekistan and the program are attached as Annexure I & II respectively.
2. During the meeting all documents as well as all presentations were made in Chinese
and Russian languages. Request was made by the Indian delegation to the host to give
English translation of documents and to be shown on the screen two in English in order to
have a better understanding and communication. It was informed that formally this request
should be made to the SCO secretariat in writing after this meeting.
3. Draft Regulation of the Working group of Experts on Forensic (Judicial Expert)
activity of the Meeting of the Ministers of Justice of the Member States of the SCO was not
discussed. However, the Working Group for the same was formed as proposed and
presented by China. Similarly, the regulations of the Working Group on Legal Services of the
SCO member States proposed by China were not discussed though the Working Group was
formed as proposed and presented by China.
4. On forensic activity, we may need to take inputs from the MHA before the Minister
level meeting proposed to be held on 20.10.2017. On Legal Services, the Department of
Legal Affairs will be working on notaries and advocates. But as far as legal assistance to the
poor and marginalised is concerned, the Department of Justice has to provide inputs.
However, the major responsibility to provide inputs rests with the Department of Legal
Affairs. The timeline to provide comments to the SCO secretariat on the Regulations of the
Working Group on Legal Services as proposed by China is 10.09.2017.
5. During deliberations it was informed that before the 5th meeting of the Ministers of
Justice of the member countries of the SCO on 20.10.2017, the Expert Group will again meet
on October 18-19, 2017. Request has been made by the Indian delegation to the SCO
secretariat to give English translation of documents informally and to be shown on the
screen two in English too in order to have a better understanding and communication.
6. In the meeting the Agenda for 20.10.2017 meeting was discussed. The draft Joint
Statement to be signed after 20.10.2017 was also discussed. Both Agenda and Joint
Statement were discussed word by word and formulated on the basis of consensus as
emerged amongst all participating countries. Attention was also drawn that on account ofDiwali festival in India on 19.10.2017, the participation of the Minister may be on
20.10.2017.
7. The minutes of the meeting were in Russian and Chinese. The assurance was given
during the meeting to provide English translation of the minutes by the host country i.e.
Uzbekistan Government.
