If no fundamental right has been infringed then supreme court can refused relief under article 32??

Article 32 is itself a Fundamental Right. ... Being the guarantor of FundamentalRights, the Supreme Court can not refuse to issue Writs. But the High Court has the Discretionary power while issuing the Writs.
