Given that I still have my own set of ethics and morality, I would surrender the case to someone less biased, and let them deal with any punishment.

Chances are that if I was dictator, I would not be so for very long, as I would diligently work towards democracy and a functioning state apparatus, including independent court, so that I could stop being dictator. But if I had not got that far, I would let the courts work according to procedure.

If I was a judge, I could not give my enemies any punishment, only those set for the crimes that they are charged with. And I would have myself dismissed from the case and let someone else handle it, if the court system would not do it already.
