In any of the cases given in the explanation RTI can reject the application but it must send a 9 Form-7 Intimation of rejection of the request for information sought under the RTI Act, 2005.

Explanation:

The request can be rejected in the following cases:

  • Citing an exemption under section 8 (1) of the RTI Act.
  • Citing an exemption under section 9 of the RTI Act.
  • Other situations in which information can be refused are: -
  • Citing any article of the Constitution.
  • For non-payment / improper payment of administrative fees.
  • If what was sought in the application is not "information".
  • If the RTI law does not apply to a particular organization, cite the exemption u / s 24.
  • If the organization from which the information is sought is not a public authority.

The CIC also invoked and cited the preamble to the RTI Act to request the exemption. If voluminous information has been sought, that information cannot be dismissed by citing subsection 7 (9) which only establishes a change in the way it should be anticipated.
