The petitioners Pramod Narayan Tiwari, Sudhish Tiwari @

Mannu Tiwari, Rajeev Tiwari @ Annu Tiwari and Vikash Tiwari have filled

the present anticipatory bail, who are apprehending their arrest in

connection with Bihta P.S. Case No.527/2019, registered U/Ss.341, 147,

148, 149, 323, 324, 307 and 379 of the I.P.C. which is pending in the Court

A.C.J.M. 1st Danapur.

The learned lawyer of the petitioners has submitted

that the petitioner no.1. is accused in Complaint Case No.580©/ 2018

IPand he is on bail, but no any criminal antecedent against the other

petitioners. The prosecution case, as per, the written-report of informant,

in brief, is as such: On 05-06-2019, the informant Nand Kishore Upadhayay

submitted his written-report to the S.H.O. Bihta P.S. in which he has

alleged that on 05-06-2019 at about 9.a.m. while his nephew Purshottam

Kumar Upadhayay was washing his cow infront of his house, then the

accused persons Pramod Narayan Tiwari, Kamlesh Tiwari @ Anil Tiwari,

Sunil Tiwari, Sudhish Tiwari @ Mannu Tiwari, Rajeev Tiwari @ Annu

Tiwari, Saurabh Tiwari @ Vicky Tiwari, Vikash Tiwari, Ankit Kant Tiwari @

Mitthu Tiwari and Sahil Tiwari @ Anku Tiwari came and accused Pramod

Tiwari and Sudhish Tiwari caught hold to Purshottam Kumar and accused

Anil Tiwari and Sunil Tiwari were assaulting him by the fists and slaps in

the, meanwhile, the accused Vicky Tiwari, Mitthu Tiwari and Anku Tiwari

assaulted upon the head of Purshottam Kumar by Bari and Lathi, causing

fracture of his head and he became unconscious and fell down. The

informant has further alleged that, when he reached there then the

accused Sunil Tiwari assaulted him with Bari upon his head and he fell

down and the accused Anil Tiwari assaulted upon his back with Bari and

accused Vicky Tiwari and Mitthu Tiwari assaulted him upon his wrist his

wrist was fractured. The informant has further alleged that when his

niece Rubi Devi came there, the accused Vicky Tiwari assaulted upon her

waist with Bari and accused Anil Tiwari assaulted upon her head with Bari,

causing her head injury. The informant has further alleged that accused

Vikash Kumar Snatched her golden 'Mangal Sutra' worth of Rs.36,000/-

and, thereafter, the accused persons fled away after threatening and

abusing them.

The learned lawyer of the petitioners has submitted

that the petitioners are quite innocent and have committed no offence,

and they have been falsely implicated in this false case due to previous

enmity. He has further submitted that the informant and his family

members have committed occurrence with the petitioners, for which
