the Indian Constitution in its original enactment defined education as state subject .Under Article 42 of the Constitution an amendment was added in 1976 and education become a concurrent list subject which enable the Central government to legislate it in the manner situated to it .

Education is listed as a subject under the concurrent list i.e both Union and State Government can take decisions on this subject.

If the decision of State and Central Government; contradict or collide each other, then the decision of Central Government will override the decision of State government.

Originally, before 1976 Education was a state subject and was enlisted under state list.

The the 42nd constitutional amendment, (which was enacted during the period of emergency) shifted education along with four other subjects from state list to concurrent list.

This this amendment is officially known as The Constitutional Act, 1976 and was presented in the parliament by H. R. Gokhale (Ex Minister of Law and Justice).
