Equality is when every person is seen as "equal" in the "eyes of the law".  Social justice is when every person can "exercise their rights" within a society

While the the Constitution of India does specify equality and justice must be be for all citizens, in India we still see inequality prevailing and many people being denied justice in all forms

Inequality in India

  • In India we can see different forms of inequality.  In India there are two forms of inequality, income and social inequality. The unequal distribution of income and opportunity among individuals and groups in society is income inequality. Social inequality is caused by the unbalanced distribution of resources within a society centred on a society which creates specific patterns along the lines of socially demarcated categories such as religion, prestige, race, kinship, caste, ethnicity , gender, etc.
  • In India, following are distinctive forms of social inequality:
  • India's richest people who are the top in the country' hold 77.4%, while the top 1% holds 51.53%. However only 4.8 per cent of the national income is in the lowest 60 % of the population. For the last 15 years, 13.6 crore Indians, who are the country's poorest 10 percent, have remained in debt.
  • Religious identities can generate biases that can contribute to economic exclusion and other types of prejudice that can affect work and livelihood opportunities. Although minorities like Parsis, Christians, & Jains have a greater share of income/consumption than their share of the population, access to economic opportunities is substantially lower for Buddhist & Muslim communities.
  • According to the "International Labor Organisation", women are paid 34 per cent lesser than men in India because of the "gender wage gap". Women make up more than 42 per cent of the nation's agricultural labour force, but, according to the "India Human Development Survey (IHDS)", they own less than 2 per cent of their farmland.
  • Caste is an essential factor for deciding access to services valued by individuals, such as education, wages, health, etc. India's upper caste households earned almost 47 per cent more than the national avg yearly household income, according to the "World Inequality Database", and in that the top 10 per cent of those castes held 60 percent of the group 's wealth in the year  2012.
  • Different ethnic movements seeking separate states or independent states or even outright independence from India have led to inequality between ethnic groups. Many such ethnic movements, such as Nagas for greater Nagalim, etc., have shaken the North East.
  • Inequalities tend to generate social conflict amongst social groups , say for instance caste groups such as Marathas, Jaats, & Patels are demanding reservations, however this demand is objected by caste groups that already claim the advantages of reservations, such "conflict of interest" tend to generate violent conflicts between conflicting caste groups because of  "perceived inequalities".
  • Religious disparity tends to build a sense of isolation amongst minority religious groups. This decreases their participation in the society and in India religious minorities with a huge population as such  their economic exclusion jeopardizes the GDP growth of the country as a whole in India.

There is no justice without equality and considering in India we continue to see inequality  prevailing in our society in different ways as mentioned above. While we are lucky to have a system that can be depended upon to offer a fair hearing and resolution, this is unfortunately not the case for millions of people in our nation. In many ways, poverty impacts access to justice, and unjust policy perpetuates and exacerbates disadvantages. Income, gender, sexuality and position may all be factors that deny people equal access to justice. Many of these factors are often severely coupled to the detriment of victims or perpetrators from already disadvantaged communities.
