John Bennet arrived for an appointment with his primary physician, Dr. Will Jepson. John explained that for the last week he had felt some burning when he urinated. Dr. Jepson ordered a series of tests. He didn’t want to make the patient upset and thus, he didn’t inform John that the tests also included STD screening. A few days later the tests came back positive for gonorrhea. Dr. Jepson called John back to the office to review the results. Dr. Jepson explained possible courses of treatment, but he forgot to mention anything about the risks of not undergoing medical treatment. After consideration John decided to refuse treatment at all. He asked the doctor not to disclose information about his diagnosis as well as his decision to his wife, as it would ruin his marriage. Dr. Jepson was conflicted about what to do, especially since he was also the primary physician for John's wife, Kate. Finally, Dr. Jepson decided to keep all the information confidential. Two months later, Kate, being 36 weeks pregnant, accidentally became aware of John’s diagnosis and decided to visit the doctor seeking an abortion. The doctor explained that there was required consent of both parents, therefore, he refused to perform the procedure. Two years later, when Kate and John were already divorced, Kate was brought by ambulance to an emergency department after a motor vehicle accident. After she was declared brain-dead, the doctor decided to turn her off the ventilator. The family was devastated and insisted on pursuing treatment. They accused the doctor of killing their daughter and threatened to sue in court. Meanwhile, the nurse found that Kate had registered in the organ registry asked Dr. Allen whether he would like her to inform the local organ bank so it could send an organ procurement representative to speak with the family. Dr. Allen said that as Kate had herself registered as a donor and the family could not override her decision, there was no need of informing the local organ bank and he could inform the family about it.
