Equity proceeds in the principle that a right or liability should as far as possible be equalized among all interested. In other words, two parties have equal right in any property, so it is distributed equally as per the concerned law.

It serves as a reminder that the spirit of the law should override the letter of the law in the interests of justice. The balance between law and justice demands careful attention at all times. If the Common Law was fixed and limited in its ability to develop then justice was denied.
