The Indian judicial system is inherited from common laws and systems that were recorded and practiced in the British colonies.
- At the top of the pyramid, we have the Supreme court. The supreme court is the highest court established by the constitution, It is a federal court and is considered the guardian of the constitution. It takes up matters that are of high importance which are passed on to them by the high court. It also takes up writ petitions in cases of severe human rights violations and cases that require immediate resolution. It comprises a chief justice and 33 judges.
- Next, we have the high courts which are state-level courts. They are the highest level in each state and are bound by the judgments and orders of the Supreme Court of India. There are 27 High courts operating at the state level. They deal with original jurisdictions in the state and also take up civil and criminal cases that have been passed on by subordinate courts if not resolved. The primary function of the High Court is to decide appeals from lower courts. Judges are appointed to the high court by the President of India after consulting with the Chief Justice of India, the chief justice of the high court, and the state governor.
- Lastly, we have the subordinate courts which deal with cases within a given district or jurisdiction, These courts deal with everything from civil cases to family matters, and much more. Appointment to these courts is either through examination or through being a retired judicial officer.
